The term Mobile Application applies to the mobile application for Android and IOS mobile or tablet named “Akidaia“.

The term Server applies to the software component of the AKIDAIA Suite with which the Mobile application communicates.

Our privacy rules include all the processing, purposes, and means of action available to individuals so that they can best exercise their rights.

The mobile app is available on Google Play and App Store.

App Content

All illustrations, animated images or not and more generally all elements reproduced or used on the mobile application are protected by the laws in force under intellectual property. They are the full and entire property of the publisher or its partners.

Any reproduction, representation, use or adaptation, in any form whatsoever, of all or part of these elements without the prior written consent of the publisher, is strictly prohibited.

The mobile application connection hardware you use is under your sole responsibility. You must take all appropriate measures to protect your equipment and your own data, from virus attacks via the Internet. The publisher cannot be held liable in the event of failure, breakdown, difficulty, or interruption of operation, preventing access to the mobile application or one of its features related to a virus attack due to the negligence of the user.

User rights

Referring to the applicable regulations to personal data, users have the following rights:

* The right of access: you can exercise your right of access, to know the personal data concerning you, by writing to the following e-mail address: data@akidaia.com

In this case, before exercising this right, the owner of the mobile application may request proof of your identity to verify its accuracy:

* The right to rectification: if the personal data held by the owner of the mobile application are inaccurate, you can request the update of the information.

* The right to erasure of data: you may request the deletion of your personal data, in accordance with applicable data protection laws.

* The right to restriction of processing: you can ask the owner of the mobile application to limit the processing of personal data in accordance with the General Data Protection Regulation (GDPR).

* The right to object to data processing: you can object to your data being processed in accordance with the assumptions provided for by the General Data Protection Regulation (GDPR).

* The right to portability: you can request that the owner of the mobile application give you the personal data provided to transmit them to another site.

All requests must be accompanied by a photocopy of a valid identity document, signed, and must mention the address at which the publisher of the mobile application can contact the applicant. The response will be sent within one month of receipt of the request. This one-month period may be extended by two months if the complexity of the request and/or the number of requests so require.

Confidentiality

We do not collect any personally identifiable information. We do not sell or trade the data collected to third parties for commercial purposes.

For the proper performance of the service and only in the event of malfunction of the service, it is possible that data may be communicated to third parties, in this case the FIREBASE website.

Personal data

From our mobile application, we do not collect any personal data (for example: names, addresses, telephone numbers, email addresses).

However, when you use our mobile application via telecommunications services to communicate with the Akidaia Server, communication data (for example, IP address) is automatically generated. The Server keeps this data, it is used only for the establishment of communication between the Mobile application and the Server for the provision of AKIDAIA services or in case of malfunction of the Mobile application.

In the event of a malfunction of the Mobile application, we collect information that is strictly necessary for debugging and recommissioning the Mobile application and is sent to the third party site FIREBASE.

The information collected is as follows:

* The type of device used,

* What version of Android or IOS is used on the device,

* The mobile operator,

* Mobile application version,

* Which connection was active (WiFi or mobile network),

* The crash-log describing in which section of the code the malfunction occurred.

Data retention

AKIDAIA keeps your data in order to provide you with its services or to provide you with assistance. This, to the extent reasonably necessary or required to satisfy legal or regulatory obligations, to resolve disputes. We may also retain some of your information as necessary, depending on security policies related to access control on a business or private site. Your data is kept during the contractual relationship and in accordance with the regulations in force.

The retention period of this data may not, under any circumstances, exceed the period necessary for the provision of the AKIDAIA service (CPCE, art. L. 34-1-III) or the strict regulatory obligations.

Permissions requested by the mobile application

* Location & Background Location for Android

No approximate (network) or precise (GPS and network) location is transmitted to our servers. Location activation is only necessary for smartphones with an Android OS version lower than version 12. Enabling background location is only necessary for smartphones running Android version 10 and 11. The location will be used to detect only Akidaia Miniboxes in the immediate vicinity of the user.

* Nearby devices for Android

This permission is used for Android devices above version 11. It will be used to detect only nearby access.

* Location for IOS

The location will be used to detect only Akidaia Miniboxes in the immediate vicinity of the user.

* NOTIFICATION for IOS & Android

Notifications are used to inform the user of changes to these accesses.

* Update background data for IOS & Android

Enable user access to be updated.

* Bluetooth for IOS and Android

Connect to the nearby Akidaia Minibox.

Governing Law

This Privacy Policy is governed by French law and subject to the jurisdiction of the courts of the publisher’s registered office.

In general, you can visit our site on the Internet without having to disclose your identity and provide personal information about yourself. However, we may sometimes ask you for information.
